Information on distance selling

I. Scope of application - contractual partners - definitions

1. These general terms and conditions apply to orders for services from customers with Tobias Forst, Achilles Life Coaching, Eduard-Hamm-Str. 12, 94036 Passau, phone +49 176 813 212 73, info@achilles-lifecoaching.com (hereinafter also referred to as "we" or "Achilles Life Coaching").
2. Customers can be adult consumers and entrepreneurs.
3. A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed (§ 13 BGB)
4. Entrepreneur is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity (§ 14 BGB)

II. Conclusion of contract - order process

1. If offered, the customer can select services (coaching) on the Achilles Life Coaching website and request / reserve them. To complete the application, the customer can click on the “Checkout / complete order” button. The customer submits a binding application to purchase the services via the “Buy now” button. Achilles Life Coaching then sends the customer an automatic confirmation of receipt by e-mail in which the customer's order is listed again and which the customer can print out using the "Print" function (order confirmation). This automatic confirmation of receipt only documents that the customer's request has been received by Achilles Life Coaching and does not yet constitute acceptance of the request.
2. A contract is only concluded with an explicit order confirmation and appointment reservation by Achilles Life Coaching within 3 working days.
3. If advance payment of the advance payment has been agreed, the contract is concluded with the provision of the bank details and payment request.

III. Prices - advance payment, payment options

1. All prices and payments are total prices in euros, including statutory sales tax and all other price components.
2. The agreed payments for the service is due immediately as an advance and must be instructed by the customer using the payment methods offered by Achilles Life Coaching.
3. If the agreed advance payment has not been received by Achilles Life Coaching after a renewed request, by 10 calendar days after sending the request for payment, Achilles Life Coaching will withdraw from the contract with the result that the order is invalid and Achilles Life Coaching has no obligation to perform. The order is then completed for the buyer and Achilles Life Coaching without any further consequences.

IV. Storage of the contract

1. The terms (contract conditions) and your order data will be stored by us.
2. The following applies to online orders: After we have received the order, the order data and the general terms and conditions are sent to the customer by email. The customer can save this information in a reproducible form or print it out with his internet browser.

V. Applicable law, place of jurisdiction, contract language

1. The law of the Federal Republic of Germany applies without of the UN sales law. In the event that the customer is a consumer, this only applies insofar as the protection granted by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.
2. If the customer is a merchant, legal entity under public law or special fund under public law, or in Germany without a place of jurisdiction, the exclusive place of jurisdiction for all disputes arising from this contract is Passau. We are also entitled to sue the customer at his general place of jurisdiction.
3. The contract language is German.

VI. Reference to the dispute settlement platform of the EU
and information according to VSBG

1. The European Commission provides a platform for online dispute resolution (OS platform). This gives consumers the opportunity to settle disputes in connection with their online order out of court. 2. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
